USER TERMS OF SERVICE
1. General Provisions
- These Terms of Service apply to relations concerning a user's ordering of services, making payments, receiving services, and submitting complaints and requests through the UBCAB platform.
- By reviewing and accepting these terms, the user enters into a contractual relationship relating to the use of the UBCAB platform.
- UBCAB is a provider of a technology platform and intermediary services that connects users with product and service providers.
- These terms apply only to service relations ordered and performed through the UBCAB platform. UBCAB is unable to supervise relations independently agreed upon by users, drivers, merchants, or other persons outside the platform.
- UBCAB may amend or supplement these terms due to legislation, types of services, technological changes, information security, payment and settlement requirements, and the need to protect users' interests.
- Changes to the Terms of Service will be notified through the UBCAB application, the www.ubcab.mn website, communication channels linked to the user's registration, and other appropriate means. If the user continues to use the services after the changes take effect, the user shall be deemed to have accepted the updated terms.
2. Definitions
- "Application" means the UBCAB mobile application, mini app, and other electronic tools through which UBCAB services may be accessed.
- "Platform" means the UBCAB application, website, mini app, software, servers, databases, payment, ordering, user registration, driver connection, and service management systems.
- "User" means an individual or legal entity registered on the UBCAB platform or ordering and receiving services through the UBCAB platform.
- "UBCAB" means "UBCAB" LLC, the owner, developer, and operator of the UBCAB platform, and its affiliated legal entities participating in each type of service.
- "Product and service provider" means a driver, merchant, delivery service provider, rental service provider, or any other person providing services to users through the UBCAB platform.
- "Driver" means a person providing passenger transport, delivery, rental, designated driver, and other related services to users through the UBCAB platform.
- "Service" means standard taxi services, passenger transport by a person with a private vehicle, car rental, express delivery, designated driver services, and other services offered by UBCAB through the UBCAB platform.
- "Payment" means the service fee, UBCAB intermediary fee, additional service fee, taxes, charges, peak-hour surcharge, cancellation fee, tip, BID, and other payments displayed in advance in the application.
- "Wallet" means an electronic record within the user's UBCAB application that displays prepaid amounts and promotional balances and may be used to pay service fees. The Wallet shall not be considered a deposit, loan, bank account, electronic money, or an independent payment instrument.
- "Personal data" means information that can directly or indirectly identify a user, driver, or other person.
- "In-app call" means the ability of the user and driver to communicate by voice through the internal technical solution of the UBCAB application for the purpose of exchanging service-related information.
- "In-trip audio recording" means the recording of the sound environment and conversations inside the vehicle through the UBCAB application on the driver's device from the time the service status changes to "trip started" until it changes to "trip completed."
- "Driver's device" means a mobile phone, tablet, or other portable device used by the driver when providing services through the UBCAB application.
- "Complaint or request" means a proposal, request, or complaint submitted to UBCAB regarding service quality, payment, safety, property, personal data, application operation, or other matters.
3. Age Restrictions
- Users aged 16 and above may independently use the UBCAB platform.
- A person aged 12 or above but under 16 may use UBCAB services with the consent of a parent or guardian, using their device or account, or under their supervision.
- If a user allows a minor to use their account, device, or payment instrument, the user shall be responsible for the payments, liabilities, and risks arising from such use, unless otherwise provided by law.
- UBCAB may establish additional age restrictions, parental or guardian consent requirements, or special conditions for certain types of services, taking into account the safety of minor users, the type of service, and the level of risk.
4. Rights and Obligations of the User
- The user has the right to order services through the UBCAB platform, review the service type, tariff, payment, cancellation terms, driver and service information, cancel services, provide ratings, and submit proposals, requests, and complaints.
- If the user considers that an unjustified payment, cancellation fee, or additional fee has been charged, the user has the right to submit a request or complaint to UBCAB.
- The user has the right to submit requests to UBCAB to exercise their rights to access, correct, delete, restrict the processing of their personal data, and exercise other rights provided by law.
- If the user considers that a risk relating to safety, health, or property has arisen during the service, the user has the right to stop the trip, refuse to receive the service, and contact UBCAB and competent authorities.
- The user is obliged to provide true, accurate, and complete information when registering on the UBCAB platform, ordering services, making payments, and submitting complaints or requests.
- The user is responsible for the security of their account, device, payment instrument, login information, and verification code. Unless otherwise provided by law, the user shall be responsible for any risks, payments, disputes, and damages arising from allowing others to use them.
- The user is obliged to fully and timely pay the service fee, cancellation fee, and additional fees calculated in the application or accepted by the user.
- The user is obliged to communicate respectfully and ethically with drivers, product and service providers, UBCAB employees, other users, and third parties.
- The user is prohibited from making false calls, repeatedly cancelling calls without valid reason, interfering with the normal operation of the platform, illegally accessing the system, inserting malicious code, modifying or copying information, or attacking through automated tools.
- The user is prohibited from establishing personal relationships unrelated to the service, or requesting, collecting, using, or disclosing personal data, payment information, or confidential information from drivers or product and service providers.
- The user is prohibited from requiring drivers or product and service providers to perform illegal, dangerous, rights-infringing actions, or actions inconsistent with service standards.
- The user is prohibited from consuming alcoholic beverages, narcotic or psychotropic substances, smoking, dirtying or damaging the vehicle, or engaging in conduct that disturbs others inside the vehicle.
- If actual damage is caused to a driver, product and service provider, UBCAB, or a third party due to the actions or omissions of the user or accompanying passenger, the user is obliged to compensate such damage within the scope provided by law.
- Relations concerning the user's personal data are governed by Article 10 of these terms, UBCAB's Privacy Policy, and relevant notices and consents in the application.
5. Rights and Obligations of UBCAB
- UBCAB has the right to ensure the normal and safe operation of the UBCAB platform, connect users with product and service providers, and organize service orders, payments, complaints, and requests.
- UBCAB has the right to establish and change service types, tariffs, payment structures, additional services, promotions, cancellation terms, and platform usage rules in compliance with legislation.
- For the purpose of ensuring the safety of users, drivers, and product and service providers, the normal operation of the platform, and compliance with legislation, UBCAB may temporarily restrict the service usage rights of a user who has committed a violation, or suspend or close the account.
- UBCAB may use trip information, payment information, in-app chat, technical information of in-app calls, in-trip audio recordings, and other lawful information to investigate complaints, payment disputes, and safety information.
- If actions that may constitute a crime, violation, fraud, or harm to the life, health, or property of others are identified, UBCAB may provide the relevant information to competent authorities on the grounds and in the manner prescribed by law.
- UBCAB has the right to carry out system updates, maintenance, and temporary restrictions for the purpose of improving the safety of the platform, application, and services, user experience, and service quality.
- UBCAB shall take feasible technical and organizational measures to ensure the normal, reliable, and safe operation of the UBCAB platform.
- UBCAB shall impose requirements on registered drivers and product and service providers regarding service standards, ethics in communicating with users, safety, and personal data protection, and shall provide necessary information.
- UBCAB shall receive proposals, requests, and complaints submitted by users and take measures to resolve them within a feasible period based on the nature of the matter, evidence, and explanations of the parties.
- UBCAB shall collect, process, store, and protect users' personal data within the grounds, purposes, scope, and period prescribed by law.
- UBCAB shall not independently make a final decision on matters that have the nature of a crime or violation, and users, drivers, product and service providers, and relevant persons have the right to contact competent authorities.
- UBCAB shall not be liable for interruptions or delays caused by the internet network, banks, payment institutions, device operating systems, third-party platforms, user devices, misuse by the user, or force majeure, unless UBCAB's fault is established.
6. Payments
- The payment for services received through the UBCAB platform shall be calculated and displayed by the application based on the service type, tariff, distance, time, demand, road conditions, peak hours, additional services, user choices, and other factors.
- The total service payment includes the product and service provider's fee, UBCAB intermediary fee, additional service fee, taxes, charges, peak-hour surcharge, cancellation fee, tip, BID, and other payments displayed in advance in the application.
- Before ordering a service, the user is obliged to review the tariff, preliminary payment estimate, additional fees, payment method, and cancellation terms displayed in the application.
- The user is obliged to fully pay the service fee calculated in the application, displayed in advance, or accepted by the user's own choice.
- The user has the right to refuse to pay additional fees that were not displayed in advance in the application and not accepted by the user. However, cleaning costs, property damage, losses, and other fees provided by law arising from the user's wrongful actions may be separately claimed.
- The user may pay service fees by cash, bank card, bank transfer, Wallet balance, gift card, coupon, promotion, and other payment methods approved by UBCAB.
- The preliminary service payment estimate may change depending on the actual distance, time, route, waiting time, road conditions, user changes, additional services, and other factors.
- When using a non-cash payment instrument, the user is responsible for the validity of the payment instrument, balance, bank and payment institution fees, and whether the transaction is successful. UBCAB shall not be liable for delays, errors, fees, or refunds in third-party payment systems, unless UBCAB's fault is established.
- If the user considers that there is an unjustified payment, duplicate transaction, incorrect amount, cancellation fee, or other payment dispute, the user may submit a request through the application and user service channels.
- Whether a payment refund, adjustment, or compensation is made shall be decided based on the nature of the transaction, whether the service was provided, whether the user was at fault, explanations of the product and service provider, bank and payment institution rules, and legislation.
7. User Prepayment and Wallet
- The user may top up the Wallet section in the UBCAB application in advance using payment methods approved by UBCAB and use it to pay for services received through the UBCAB platform.
- The Wallet balance is only a prepaid payment right intended for receiving services and making payments through the UBCAB platform, and shall not be considered a deposit, loan, bank account, electronic money, or an independent payment instrument.
- When topping up the Wallet, the user is obliged to correctly enter the transfer purpose, user registration, phone number, transaction amount, and other necessary information.
- When processing refunds for mistaken transactions, overpayments, or transactions with incorrect amounts, UBCAB shall verify the relevant transaction receipt, user registration, payment institution information, and other necessary documents.
- In the event of a refund, the amount may be returned to the original payment instrument or account from which the transaction was made. Bank and payment institution fees, transaction timeframes, and verification conditions may apply.
- Balances created by coupons, promotions, bonuses, or promo codes shall be used only within the services, period, and purposes specified in the relevant promotion terms. Unless otherwise provided by law or the relevant promotion terms, they shall not be refunded in cash, transferred to others, or withdrawn to a bank account.
- If circumstances indicating possible fraud, illegal transactions, use of another person's payment instrument, use of a system error, or creation of multiple accounts are identified, UBCAB has the right to temporarily restrict the use of the Wallet, coupon, or promotion and conduct an investigation.
8. Calls, Cancellations, and Service Process

Calls and Cancellations
- When ordering a service through the UBCAB platform, the user is obliged to correctly select the service type, number of passengers, pickup and destination locations, payment method, additional services, special requirements, and other necessary information.
- Before confirming a call, the user shall have reviewed the tariff, preliminary payment estimate, additional fees, cancellation terms, and available information about the driver and product and service provider displayed in the application.
- A call shall be accepted and performed depending on the technical capability of the UBCAB platform, availability of the driver and product and service provider, location, service type, payment terms, and other factors.
- The user may cancel the call before the driver or product and service provider accepts the call.
- If the driver has accepted the call and has started moving toward the location specified by the user, or has arrived at the specified location, and the user cancels the call, a cancellation fee notified in advance in the application may be charged.
- If the user considers that a cancellation fee has been charged without justification, the user may submit a request through the application and user service channels. If it is determined to be unjustified, UBCAB may cancel the fee, refund it, or make an adjustment to the Wallet.
- If the user repeatedly makes or cancels calls without valid reason or interferes with the activities of drivers and product and service providers, UBCAB may temporarily restrict the right to use services, inspect the account, or suspend the account.

Service Process
- During the service, the user shall comply with the pickup and destination locations, service type, number of passengers, baggage size, payment terms, and other related conditions specified in the application.
- The user has no right to require more passengers than permitted to be transported, to require transportation of baggage or items unsuitable for the service type, or to require transportation of illegal, dangerous, or prohibited items.
- The driver and product and service provider have the right to refuse to provide the service if they consider that the user's request does not comply with legislation, service terms, safety requirements, vehicle capacity, or the service type.
- The user may request a route change, additional stop, or change to service conditions during the trip, and the payment, time, and service conditions may change as a result.
- If the user or accompanying passenger causes damage to the vehicle, soils it, damages items, or causes damage to the driver or a third party, the relevant damage shall be compensated within the scope provided by law.

In-App Calls
- The user and driver may use UBCAB in-app calls to exchange information related to service location, pickup and destination points, trip conditions, payment, and service process.
- An in-app call is a separate form of communication from an in-trip audio recording, and technical information such as the date, time, duration of the call, and registration information of the connected parties may be stored for the purposes of service safety, complaint handling, and dispute resolution.
- The user and driver shall use in-app calls only for exchanging service-related information and are prohibited from establishing personal relationships unrelated to the service or requesting, collecting, using, or disclosing another person's personal data.

In-Trip Audio Recording
- The driver may make an in-trip audio recording through the technical solution of the UBCAB application for the purpose of protecting the safety of the vehicle owned, possessed, or used by the driver or another person, as well as life, health, and property.
- The in-trip audio recording is made from the time the service ordered by the user changes to "trip started" status in the driver's application until it changes to "trip completed" status.
- Although the in-trip audio recording is made inside the driver's private vehicle, because it is made through the UBCAB application within the scope of the service relationship, it may contain personal data of the user, driver, and accompanying passenger. Therefore, UBCAB shall collect, process, and store such information in accordance with the law.
- In-trip audio recordings are used to protect the safety of the driver, user, and accompanying passenger, ensure the integrity of the driver's vehicle and property, investigate complaints, disputes, violations, and illegal acts arising during the service, and prevent risks such as fraud, violence, threats, and property damage.
- If an in-trip audio recording is to be made, the user shall be notified in advance through the application in a clear and understandable form before the trip begins.
- If the user reviews the in-trip audio recording notice and starts or continues the trip, the user shall be deemed to have consented to audio recording during that trip.
- If the user does not consent to audio recording, the user has the right not to start the trip or to cancel the trip. Due to the need to protect the driver's safety and the integrity of the vehicle, in-trip audio recording may be a condition for providing certain services.
- The driver may not use, copy, download, edit, delete, or transmit in-trip audio recordings to social media, media outlets, or third parties for personal purposes.
- UBCAB shall not use in-trip audio recordings for advertising, marketing, public distribution, unlawful monitoring of users or drivers, biometric identification, or behavioral assessment.
- UBCAB stores in-trip audio recordings for 90 days under ordinary circumstances. If a complaint, dispute, violation, investigation, insurance claim, or request from a competent authority arises, the recording may be stored until the relevant matter is finally resolved.
- Only authorized UBCAB employees may access and listen to in-trip audio recordings as required by their official duties and subject to access restrictions. Actions of accessing, listening to, copying, or transmitting recordings shall be logged.
- The user or driver may submit a request to access an in-trip audio recording related to them. When resolving the request, UBCAB shall take into account the personal data and lawful interests of other persons, information security, and restrictions provided by law.
- If required by a competent authority on the grounds and in the manner prescribed by law, UBCAB may present, allow listening to, or provide a copy of the in-trip audio recording.

Safety and Service Termination
- If a risk arises to the life, health, property, or safety of the user, driver, or product and service provider, either party has the right to stop the service, get out at a safe location, and notify UBCAB and competent authorities.
- The driver has the right to refuse to provide service to a user who has consumed alcoholic beverages, narcotic or psychotropic substances, or has committed violence, threats, insults, property damage, or illegal acts.
- If the service is stopped for safety reasons, issues of payment, cancellation, damage, and complaints shall be resolved based on the circumstances, explanations of the parties, system records, and available evidence.
9. Rating the Driver and Submitting Complaints
- After receiving the service, the user may provide a rating and feedback based on the service quality, communication, safety, vehicle condition, punctuality, and other indicators of the driver or product and service provider.
- When providing a rating or feedback, the user is obliged to be truthful and objective and not to infringe the honor, reputation, personal data, or lawful interests of others.
- UBCAB may use ratings, feedback, and complaint information provided by the user for the purposes of improving service quality, evaluating the standards of drivers and product and service providers, and investigating disputes.
- The user may submit complaints and requests to UBCAB regarding service quality, driver communication, payments, cancellations, property, safety, personal data, application operation, and other matters.
- Complaints and requests may be submitted through the complaint and request section of the application, user service phone line, chat, email, and other channels approved by UBCAB.
- When submitting a complaint, the user shall provide the relevant trip number, date, time, service type, payment information, description of the event, evidence, and other necessary information truthfully and accurately to the extent possible.
- UBCAB may investigate complaints based on trip information, payment information, in-app chat, technical information of in-app calls, in-trip audio recordings, explanations of the parties, and other lawful information.
- If the user considers that they left, forgot, or lost their belongings in the vehicle, the user shall submit a request to UBCAB as soon as possible. UBCAB shall take feasible measures such as contacting the driver who performed the relevant trip, checking trip information, and connecting the parties.
- UBCAB shall not be liable for the integrity, loss, or damage of personal belongings that were under the control of the driver or user, unless UBCAB's fault is established.
- For matters that have the nature of a crime or violation, or that create a serious risk to life, health, property, or safety, the user, driver, and product and service provider have the right to directly contact competent authorities. UBCAB is not an authority empowered to independently make a final determination or resolution of such matters.
- If safety complaints, threats, violence, property damage, payment evasion, fraud, unlawful use of another person's personal data, or similar actions are identified, UBCAB may temporarily restrict service usage rights, suspend the account, and conduct an investigation.
- Based on the results of the complaint investigation, UBCAB may take measures such as adjusting payments, invalidating cancellation fees, refunding to the Wallet, warning the driver, restricting service usage rights, suspending the account, or considering the complaint unfounded.
- If the user disagrees with UBCAB's complaint decision, the user has the right to request reconsideration or to contact a competent authority or court in accordance with the procedure provided by law.
10. Privacy of User Information and Processing of Personal Data
- UBCAB may collect, process, and store the user's personal data for the purposes of providing services, connecting the user with product and service providers, making payments and settlements, ensuring service safety, resolving complaints and disputes, and fulfilling legal requirements.
- Depending on the characteristics of the service, UBCAB may process the user's contact information, location, trip information, payment information, device information, complaints and requests, technical information of in-app calls, and in-trip audio recordings.
- UBCAB may transfer user information, to the extent necessary for providing the service, to drivers, product and service providers, payment institutions, banks, the E-Barimt system, insurance organizations, information technology service providers, user service units, and contracted service providers.
- If required by a competent authority on the grounds and in the manner prescribed by law, UBCAB may present or provide copies of user registration information, trip information, payment information, complaint records, in-trip audio recordings, and other related information.
- UBCAB shall not unlawfully sell or lease the user's personal data, or transfer it to third parties for advertising purposes without permission, and shall take feasible measures to ensure information security.
- The user may submit requests to UBCAB to exercise their rights to access, correct, delete, restrict the processing of their personal data, withdraw consent, and exercise other rights provided by law. When resolving such requests, UBCAB shall take into account legal retention obligations, the rights of other persons, information security, and the existence of complaints or disputes.
11. Delivery of Notices
- UBCAB may deliver service information, order status, payments, complaint responses, safety notices, changes to terms, and other related information to the user through the application, SMS, email, chat, phone call, the www.ubcab.mn website, and other appropriate channels.
- The user is obliged to keep their registered phone number, email, application notification settings, and contact information accurate and up to date. The user shall bear the risk of not receiving notices due to incorrect, outdated, or inactive information.
- The user and driver may exchange only service-related information through UBCAB in-app calls, chat, and other in-app channels approved by UBCAB.
- If an in-trip audio recording is to be made, the user shall be notified in advance before the trip begins through the application and/or other understandable means. The notice shall generally include the purpose of recording, retention period, user options, and related terms. A notice may also be placed inside the vehicle stating that audio recording may take place.
- When submitting complaints, requests, proposals, or information to UBCAB, the user may use in-app chat, the complaint and request section, user service phone line, email, and other channels approved by UBCAB.
- The user may opt out of marketing and promotional notices or change their settings in accordance with law and application settings. However, UBCAB may deliver necessary notices relating to service safety, payments, orders, changes to terms, and legal requirements.
12. Liability and Dispute Resolution
- Any person who violates these Terms of Service, additional terms for each service type, UBCAB rules and procedures, and applicable legislation shall bear liability provided by law.
- The user, driver, and product and service provider shall be liable, on the grounds and within the scope provided by law, for damage caused to the life, health, property, honor, personal data, or information security of others due to their wrongful actions or omissions.
- UBCAB shall be liable, on the grounds and within the scope provided by law, for actual damage caused to the user due to UBCAB's wrongful actions or omissions.
- UBCAB is a technology platform and intermediary service provider that connects users with product and service providers, and shall not be liable for the actions or omissions of product and service providers, service quality, communication, vehicle condition, or damage caused to third parties, unless UBCAB's fault is established.
- UBCAB shall not be liable for interruptions, delays, payment failures, or service interruptions caused by the internet network, banks, payment institutions, card issuers, device operating systems, third-party platforms, user devices, misuse by the user, or force majeure, unless UBCAB's fault is established.
- Payment calculations, driver location, arrival time, trip duration, route, and service availability on the UBCAB platform may change due to technical and actual conditions, and disputes shall be resolved based on the circumstances, system records, explanations of the parties, and other evidence.
- In disputes between the user and product and service provider relating to service quality, payment, property, damage, or communication, UBCAB may support resolution through the information, records, and complaint channels available to it. Disputes involving crimes, violations, or civil damages shall be resolved by competent authorities or courts.
- The parties shall first endeavor to resolve service-related complaints and disputes through UBCAB's user service and complaint handling channels. If the dispute cannot be resolved by mutual agreement, it shall be resolved by applying to a competent authority or court in accordance with the legislation of Mongolia.
- The legislation of Mongolia shall apply to these Terms of Service and relations related to the use of the UBCAB platform.
Appendix 1. Additional Terms for Private Passenger Transport Services
- When using private passenger transport services, the user is obliged to correctly select the service type, number of passengers, baggage, destination, and payment terms.
- It is prohibited to carry more passengers than the number of seats in the vehicle, to transport baggage unsuitable for the service type, or to transport illegal, dangerous, or prohibited items.
- The user is prohibited from consuming alcoholic beverages, smoking, dirtying or damaging the vehicle, or engaging in actions that create risks to the safety of the driver and other passengers inside the vehicle.
- If the user selects a special setting such as "quiet trip," the driver shall respect and implement that setting to the extent possible.
- If damage is caused to the vehicle, driver, or third party due to the wrongful actions of the user or accompanying passenger, the user shall compensate such damage within the scope provided by law.
- When ordering delivery services, the user is obliged to accurately provide the type, size, and weight of the item to be delivered, pickup and delivery locations, recipient information, and contact number.
- The owner or possessor of the item to be delivered shall be the user, and the recipient shall be a person authorized to receive the item.
- The driver has the right to refuse to accept cargo whose size, weight, packaging, or safety risk is unsuitable for the relevant service type.
- The following items are prohibited from being transported by delivery: explosive, flammable, or hazardous substances; narcotic and illegal substances; unregistered or prohibited medicines; weapons and weapon-like items; cash and securities; state registration documents; animals; human bodies and organs; items with pornographic or illegal content; and other items prohibited by legislation.
- The user shall bear the risks associated with transporting perishable, fragile, unpackaged, or high-value items.
- If delivery is delayed, returned, or additional costs arise due to incorrect or incomplete recipient information, unreachable phone number, or unclear address, the user shall be responsible.
- If the user may pay an additional insurance fee and transport the cargo with insurance, insurance compensation shall be resolved based on the insurer's contract terms and legislation.
- Rental services may be provided with a driver, without a driver, with a loader, or in other forms offered by UBCAB depending on the service type.
- When ordering rental services, the user is obliged to accurately provide the service type, duration, location, vehicle category, driving entitlement, payment terms, and other necessary information.
- In the case of rental without a driver, the user is obliged to hold a driver's license authorizing them to drive the relevant category of vehicle and to comply with traffic rules and safety requirements.
- If necessary, a vehicle deposit, additional guarantee, handover certificate, insurance, and other conditions may be required during the rental period.
- From the time the user receives the vehicle until it is returned, the user shall be responsible for the integrity, use, fines, violations, and damage relating to the vehicle within the scope provided by law and contractual terms.
- If the vehicle is damaged or suffers loss, spare parts are replaced, the vehicle is soiled, the period is exceeded, or fines or additional costs arise, the relevant costs may be collected from the user.
- If an insured event occurs, compensation, deductible, document preparation, and refusal conditions shall be resolved based on the insurer's contract terms and legislation.
- Designated driver service is a service whereby a vehicle owned, possessed, or used by the user is driven by a driver according to the user's order and delivered to the location selected by the user.
- When ordering the service, the user is obliged to accurately provide the vehicle make, registration number, location, destination, fuel amount, technical condition, insurance, documents, and other necessary information.
- The user's vehicle must be technically fit to participate in road traffic and meet the requirements prescribed by law regarding state registration, insurance, inspection and diagnostics.
- The driver has the right to refuse to provide the service if the driver considers that the technical condition of the vehicle, documents, safety, the user's physical condition, or service provision conditions are risky.
- During the service, the user is prohibited from distracting the driver, requiring a violation of traffic rules, requiring speeding, or requiring travel in an illegal direction.
- The driver shall drive the user's vehicle only along the route ordered by the user and for the purpose of the service, in compliance with traffic rules and safety requirements.
- The user shall bear the risks, delays, and damages arising from pre-existing damage, technical defects, document violations of the user's vehicle, or incorrect information provided by the user.
- If an accident, damage, fine, third-party damage, or insured event occurs during the designated driver service, the user, driver, and UBCAB shall resolve the circumstances based on relevant documents, explanations, insurance terms, and legislation.
- Insurance protection, compensation amount, coverage, and limitations related to the designated driver service shall be notified to the user through the application, additional service terms, or insurance terms.
- The user is responsible for the integrity of valuables, documents, cash, personal belongings, devices, and baggage inside the vehicle. The driver and UBCAB shall not be liable for items not disclosed, registered, or left unprotected by the user, unless the fault of the driver or UBCAB is established.
